Terms of Use, Event Participation Waiver, and Release

periPower Event

Montgomery County, Pennsylvania

Effective Date: February 1, 2026
 

These Terms of Use, Event Participation Waiver, and Release (“Agreement”) govern your use of the periPower website (the “Site”) and your purchase of tickets for or attendance at the periPower live event (the “Event”) held in Montgomery County, Pennsylvania.
 

By accessing the Site, purchasing a ticket, registering for, or attending the Event, you agree to be legally bound by this Agreement. If you do not agree, do not use the Site or attend the Event.
 

1. Eligibility

You must be at least 18 years of age to use this Site or attend the Event. By using the Site or purchasing a ticket, you represent that you are 18 or older.
 

2. Website Use

You agree not to:

  • Use the Site for unlawful purposes

  • Attempt to interfere with Site security

  • Copy or misuse periPower intellectual property

  • Use automated scraping tools without permission

All Site content, branding, materials, videos, and programming are the property of periPower or its licensors and may not be used without written consent.
 

3. Event Information Disclaimer

Event details, speakers, schedules, sponsors, programming, and venue information are subject to change at any time without notice.

The Event is provided on an “as is” and “as available” basis.
 

4. No Medical Advice Disclaimer

The periPower Event and related content are educational and informational in nature.

Nothing presented at the Event, on the Site, in marketing materials, or by speakers, panelists, sponsors, or affiliates constitutes:

  • Medical advice

  • Diagnosis

  • Treatment recommendations

  • A substitute for consultation with a licensed healthcare provider

You should consult your physician or qualified healthcare professional before making any health-related decisions.

You acknowledge that you are solely responsible for your personal health decisions.
 

5. Assumption of Risk

Attendance at a live event involves inherent risks, including but not limited to:

  • Personal injury

  • Illness, including communicable diseases

  • Accidents or falls

  • Emotional distress

  • Property damage or theft

  • Interactions with other attendees or sponsors

You voluntarily assume all risks associated with attending the Event, whether known or unknown.
 

6. Communicable Disease Acknowledgment

You acknowledge that:

  • The Event involves in-person attendance.

  • Exposure to communicable diseases, including but not limited to COVID-19, influenza, or other viral or bacterial illnesses, is possible in any public setting.

By attending, you voluntarily assume the risk of exposure or infection.

You agree not to attend if you are experiencing symptoms of illness or have been advised to isolate or quarantine.

To the fullest extent permitted by Pennsylvania law, you release periPower and its affiliates from claims arising from communicable disease exposure in connection with the Event.
 

7. Release of Liability

To the fullest extent permitted by Pennsylvania law, you release, waive, and discharge periPower, its organizers, contractors, volunteers, affiliates, sponsors, speakers, panelists, venue operators, and their respective officers, employees, and agents (“Released Parties”) from any and all claims, liabilities, damages, or causes of action arising out of or related to:

  • Attendance at or participation in the Event

  • Travel to or from the Event

  • Acts or omissions of other attendees

  • Sponsor activities

  • Conditions of the venue

This release applies to claims of ordinary negligence to the fullest extent permitted by Pennsylvania law but does not apply to gross negligence or willful misconduct where prohibited by law.
 

8. Media Release

By attending the Event, you grant periPower an irrevocable, worldwide, royalty-free license to use your name, image, likeness, and voice captured during the Event for promotional, marketing, educational, and commercial purposes in any media format without compensation.
 

9. Sponsor Disclaimer

Sponsors may distribute materials, conduct promotions, or collect information during the Event.

periPower is not responsible for sponsor products, services, communications, privacy practices, or promotional activities.
 

10. Refund Policy

Tickets are refundable up to seven (7) days prior to the Event date.

  • Refund requests must be submitted in writing.

  • No refunds will be issued within 7 days of the Event.

  • Service fees charged by third-party ticketing platforms may be non-refundable.

If the Event is canceled by periPower, ticket holders will receive a refund of the ticket price paid, excluding non-refundable processing fees.

If the Event is postponed or rescheduled, tickets will be valid for the new date. Refunds in such circumstances will be provided at periPower’s discretion.
 

11. Removal and Conduct

periPower reserves the right to refuse entry or remove any attendee for disruptive, unsafe, unlawful, or inappropriate behavior without refund.
 

12. Limitation of Liability

To the fullest extent permitted by law:

  • periPower shall not be liable for indirect, incidental, special, consequential, or punitive damages.

  • Total liability shall not exceed the amount paid for the Event ticket.
     

13. Indemnification

You agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, or expenses (including attorneys’ fees) arising from:

  • Your conduct at the Event

  • Your violation of this Agreement

  • Your violation of any law
     

14. Privacy

Your use of the Site is also governed by the periPower Privacy Policy and Sponsor Data Addendum, which are incorporated by reference.
 

15. Governing Law and Venue

This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania.

Any dispute shall be brought exclusively in:

  • The Court of Common Pleas of Montgomery County, Pennsylvania, or

  • The United States District Court for the Eastern District of Pennsylvania.

You consent to the jurisdiction of these courts.
 

16. Severability

If any provision of this Agreement is deemed unenforceable, the remaining provisions remain in full force and effect.
 

17. Acknowledgment

By purchasing a ticket, checking a required consent box, or attending the Event, you acknowledge that:

  • You have read this Agreement carefully.

  • You understand that you are waiving certain legal rights, including the right to sue.

  • You voluntarily agree to be bound by its terms.
